Ethics Complaint Could Oust Republican Rep. Scott Perry from Congress

U.S. Rep. Scott Perry is not qualified to represent the voters in Pennsylvania’s 10th Congressional District, according to two of his constituents who filed an ethics complaint against him Friday.

The 14POINT3 Campaign is a project of Free Speech For People, a not-for-profit group working to defend our democracy and the Constitution. The campaign’s name is inspired by Section 3 of the 14th Amendment, enacted immediately following the Civil War. The law serves to disqualify from elected office individuals who violate their oath to uphold the Constitution by participating in seditious conduct.

Perry’s constituents Susan Roller and Marlene Kanuck, along with Indivisible and Free Speech for People, filed a detailed complaint with the House Committee on Ethics against the U.S. congressman from York County, citing that section of the Constitution:

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

The complaint centers on Perry’s direct involvement with attempting to subvert the results of the 2020 election by promoting conspiracy theories and proposing the removal and replacement of the acting Attorney General with someone willing to fight Joe Biden’s election victory.

“As we continue to learn more about the January 6 insurrection, it is clearer than ever that Rep. Perry played a central inside role in one of the worst attacks on our democracy in our country’s history,” said Meagan Hatcher-Mays, Director of Democracy Policy at Indivisible.

In addition to promoting fictional voting irregularities in Pennsylvania, Perry also alleged British and Italian agents, via satellite, were covertly manipulating U.S. voting machines and that now former CIA Director Gina Haspel was involved in concealing the supposed plot to alter vote results.

Perry was also responsible for introducing then President Donald Trump to Philadelphia native and environmental attorney Jeffrey Clark. It is alleged that Clark was to do Trump’s bidding once installed as the Acting Director of the Department of Justice following the removal of Jeffrey Rosen from that role.

According to the complaint, the House Committee on Ethics has a few options:

The Chair and Ranking Minority Member have 14 calendar days or 5 legislative days, whichever occurs first, to determine whether the information meets the requirements of the Committee’s rules for what constitutes a complaint. If so, then they have 45 calendar days or 5 legislative days, whichever is later, to either establish an investigative subcommittee, request that the full Committee extend the 45-day period, or recommend that the full Committee dispose of the complaint.”

Earlier in September, a New Mexico judge had Republican County Commissioner Couy Dale Griffin, founder of Cowboys for Trump and a willing participant in the January 6 insurrection, removed from office following a lawsuit that invoked Section 3 of the 14th Amendment. Griffin is also prohibited from holding elected office in the future.Could a similar fate befall the newly elected GOP Committeewoman for Doylestown’s second district? Dawn Bancroft was recently sentenced to two months of incarceration followed by three years of probation for her participation in the Jan. 6 attack on the Capitol.

This newly filed complaint against Rep. Perry adds yet another facet to the continued investigations into Jan. 6.

The House Select Committee is scheduled to make public additional information regarding their investigation in a televised presentation on Sept. 28.
